Italy

Italy has no "freedom of panorama" provision in its copyright law. Since there is no specific discipline, it must be considered lawful and therefore possible to freely photograph all the visible works. It can be considered that there is de facto freedom of panorama in Italy regarding works permanently placed in the public space, in particular contemporary architectural works and monuments.

If the photographed subject is a work of a living artist (or architect), it can only be freely used for scientific or educational purpose only [2/2008-01-09 art.2], as there is a de facto FOP for non-commercial purpose [Parliamentary pronouncement n. 4-05031/2008].

See COM:CRT/Italy#Freedom of panorama for more information.

While the Public Domain Mark is not intended to be used as a license, community consensus has found that when a copyright holder applies the PDM to their own work, they are declaring their work to be in the public domain.

If a file is tagged PDM by someone other than the copyright holder, a more specific copyright tag such as one found at Commons:Copyright tags/General public domain must be applied. If this is your own work, please use {{Cc-zero}} instead.
